By signing below, the above-named Team/Club/Company, hereby grants permission and affirms that it has obtained appropriate consent from all participants (or their legal guardians, if minors) to hereby grant permission to Andrea Evensen (Swell Shots) (hereafter “Swell Shots”) to take and use photos, videos, content, name, and likeness of Team/Club/Company and its participants for the following purposes, including the right to grant sublicenses to any and all of said rights, without any compensation, royalties, or review: website viewing, printing, and downloading; publication in print and digital formats; social media, Internet, and other electronic platform use; and any and all commercial and promotional use, and further hereby acknowledges and agrees that all pictures, videos, and content produced by Swell Shots and its sublicensees, including all copyrights and other intellectual property, are the sole and exclusive property of Swell Shots. Team/Club/Company also hereby grants Swell Shots a non-exclusive, royalty-free license to display its trademark on Swell Shots’ website and promotional materials for the purpose of indicating that it has used Swell Shots’ services. In the event that any participant or his/her guardian disputes such consent, Team/Club/Company agrees to indemnify and hold harmless Swell Shots from any and all claims, liabilities, damages, and expenses arising from such disputes. Team/Club/Company understands that this electronic consent and signature are legally binding and carry the same force and effect as a handwritten signature. Team/Club/Company’s consent and agreement are evinced by the typewritten signature of its above-named Authorized Representative, below *
